I bought a phone on eBay (Omnia, for about 170) I received, used and left positive feedback. (within a day)
(Next Day) I came to charge the phone, it won%26#039;t charge at all, and now the phone is dead and useless.
The seller maintains that it was working fine when he sent it out.
Do I start a dispute? I%26#039;m slightly confused about the whole process, where should I go from here?
With luck, you paid by PayPal, as this is the best chance you have of getting your money back.
If you did, log into your PayPal account and click on the Resolution Centre link. You can then start a %26quot;dispute%26quot;. If you can%26#039;t come to an agreement with the seller, you need to escalate that dispute to a %26quot;claim%26quot; (and this is the point that PayPal actually becomes involved).
Assuming that PayPal find in your favour, you%26#039;ll need to return the phone - at your own expense and by trackable means (Special Delivery, for your own security) - and you%26#039;ll get a refund for the item and the initial postage costs.
Don%26#039;t close a claim/dispute until you%26#039;re 100% happy because claims/disputes can%26#039;t be reopened.
If you paid by some other means, you can start a dispute through eBay, but all they do is mediate so you still have to thrash things out with the seller yourself.
If the seller is registered with eBay as a business seller, and the phone was a %26quot;buy it now%26quot; item, you do have rights under the Distance Selling Regulations, but enforcing those rights is another matter - all you can really do is make the seller aware that you %26quot;know your rights%26quot; and hope that they cave in.
Hopefully you paid via pay pal? If this is so, start a claim through pay pal, not ebay. I have had to use this method several times and have always managed to receive my money back from the seller.
They will ask you to send the phone back at your expense and also, you won%26#039;t get your postage and package cost back, but you will get the price of the phone back.
Go onto pay pal, on to your account, and start a dispute under options.
